These Terms and Conditions ("Terms") govern your use of the services provided by ABC Phones Of North Carolina, Inc. ("we," "us," or "our"), operating under the trade name Water Bury Phones, at our retail location at 810 N Main St, Waterbury, CT 06704, our website at waterburyphonesllc.com, and any related communications. Please read these Terms carefully before using our services.
1. Acceptance of Terms
By bringing a device to our store for service, submitting our online contact form, purchasing a device, or using any service offered by ABC Phones Of North Carolina, Inc., you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions, as well as our Privacy Policy, which is incorporated herein by reference.
If you do not agree with any part of these Terms, please do not use our services. We reserve the right to modify these Terms at any time, and such modifications shall be effective immediately upon posting on our website. Your continued use of our services following the posting of any changes constitutes your acceptance of those changes.
These Terms apply to all customers, visitors, and others who access or use our services, regardless of whether a formal written service agreement has been entered into.
2. Services Provided
ABC Phones Of North Carolina, Inc. provides the following categories of services:
- Device Repair Services: Hardware repair of smartphones, tablets, laptops, desktop computers, and other electronic devices, including but not limited to screen replacement, battery replacement, charging port repair, and water damage treatment.
- IT & Software Services: Operating system installation and reinstallation, virus and malware removal, software troubleshooting, data migration, network setup and configuration, and security hardening.
- Data Recovery Services: Attempts to recover data from failed, damaged, or formatted storage media, including hard drives, SSDs, flash drives, SD cards, and smartphones.
- Device Sales: Sale of new, pre-owned, and refurbished devices and accessories. All used and refurbished devices are sold in "as-is" condition unless otherwise stated in writing at the time of purchase.
- Security Services: Antivirus installation, network security configuration, and related cybersecurity consulting for home and small business customers.
We reserve the right to refuse service to any customer or device at our sole discretion, including but not limited to situations where service poses a safety risk, the device has been tampered with in a manner that complicates repair, or the customer has previously violated these Terms.
3. Repair Warranty
ABC Phones Of North Carolina, Inc. provides a 90-day limited warranty on parts and labor for all repair services performed at our store, subject to the following conditions:
- Covered: Defects in the parts installed by us and workmanship issues directly related to the repair performed. If a repaired component fails due to our workmanship within 90 days of the repair date, we will repair or replace it at no additional charge.
- Not Covered: Physical damage, liquid damage, unauthorized modifications, normal wear and tear, damage resulting from misuse, accidents, or repairs performed by any third party after our service. Pre-existing damage to other components unrelated to the repair is not covered.
- Claiming Warranty: To claim warranty service, present your original service receipt at our store within the 90-day period. Warranty claims are subject to inspection to verify eligibility.
- Software Services: Software installations, OS configurations, and malware removal services carry a 30-day warranty against recurrence of the same reported issue, provided the device is used normally and not reinfected through negligent behavior.
- Data Recovery: Data recovery services are provided on a best-effort basis. We do not warrant that all data will be recovered, and the warranty for data recovery services covers only our labor process, not the completeness of the recovered data.
4. Payment Terms
Payment for all repair and service work is due upon completion of the service, at the time of device pickup. We accept cash, major credit cards, and debit cards. Specific payment arrangements may be agreed upon in writing prior to service commencement.
- Estimates: Written estimates are provided upon request before beginning work. If the actual cost of repair exceeds the estimate by more than 10%, we will contact you for approval before proceeding.
- Parts Orders: For repairs requiring special order parts, we may require a deposit equal to the cost of the part before ordering. Deposits are non-refundable if you cancel the repair after parts have been ordered.
- Device Sales: All device sales are final at the time of purchase unless a defect covered under the stated device warranty is identified within the warranty period.
- Dispute Resolution: If you dispute any charge, please notify us within 10 business days of the invoice date. We will review the dispute and work in good faith to resolve it.
5. Limitation of Liability
To the maximum extent permitted by applicable law, ABC Phones Of North Carolina, Inc. shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages arising out of or related to the services provided, including but not limited to:
- Loss of data, profits, revenue, business, or goodwill, even if we have been advised of the possibility of such damages
- Damage to a device or its components that was pre-existing or results from conditions unrelated to the specific repair performed
- Failure of data recovery attempts — data recovery is never guaranteed, and we are not liable for data that cannot be recovered
- Any third-party software, services, or products used in connection with our services
- Interruption of service, loss of use, or business interruption resulting from device downtime during repair
Our total liability to you for any claim arising from our services shall not exceed the total amount you paid us for the specific service giving rise to the claim. Some jurisdictions do not allow the exclusion of implied warranties or limitation of liability for incidental or consequential damages, so some of the above limitations may not apply to you.
6. Data & Privacy for Devices Brought In for Repair
When you bring a device to us for service, you acknowledge and agree to the following regarding the data stored on your device:
- Backup Responsibility: You are solely responsible for backing up all data on your device before bringing it in for service. We strongly recommend performing a full backup before any repair. We are not responsible for data loss during the repair process, even if data loss is unrelated to the specific repair.
- Access Authorization: By leaving a device with us, you authorize our technicians to access the device to the extent necessary to diagnose and complete the repair. We will not intentionally access personal files, photos, messages, or accounts beyond what is necessary for the repair.
- Confidentiality: Our technicians are trained to treat customer data with strict confidentiality. We do not copy, share, or use customer data for any purpose other than providing the requested service.
- Factory Reset: For certain repairs (particularly OS reinstallations and severe malware infections), a factory reset may be necessary. We will always seek your explicit consent before performing a factory reset and will make reasonable attempts to recover data beforehand.
7. Unclaimed Devices
Devices left at our store for repair that are not picked up within 30 days of notification of service completion will be considered abandoned. The following process applies to unclaimed devices:
- We will attempt to contact you at the phone number and email address provided at intake at least three times over the 30-day period.
- After 30 days from the date of our first notification that your device is ready, and after reasonable contact attempts have been exhausted, we reserve the right to recycle, dispose of, or repurpose the device to recover outstanding service charges.
- We are not liable for data loss or device loss resulting from abandonment under these circumstances.
- If you need additional time to pick up your device, please contact us — we will make accommodations when notified in advance.
- Devices with outstanding balances owed may be held until payment is received, and storage fees may apply after 7 days.
8. Governing Law
These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Connecticut, without regard to its conflict of law provisions. Any dispute arising under these Terms that cannot be resolved informally shall be subject to the exclusive jurisdiction of the state and federal courts located in New Haven County, Connecticut.
You agree to submit to the personal jurisdiction of such courts and waive any objection to the laying of venue in such courts. If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and ABC Phones Of North Carolina, Inc. with respect to the subject matter herein and supersede all prior understandings, agreements, representations, and warranties, both written and oral.
